Consequences of Overstaying for Foreign Workers in Korea

Many foreign workers mistakenly believe that overstaying for a few days is not a serious issue. However, under Korea’s Immigration Control Act, even a one-day overstay is considered illegal residence and may result in administrative penalties.



Depending on the length of the overstay and how it is discovered, consequences may include fines, departure orders, or forced deportation accompanied by entry bans. Longer overstays or detection through enforcement inspections often lead to harsher outcomes.



An overstay record can also negatively affect future visa extensions or changes of status. Voluntary reporting to immigration authorities is generally viewed more favorably than being apprehended.



If a foreign worker becomes aware of an overstay, it is crucial to assess the situation carefully and respond appropriately, as early and informed action can significantly reduce future legal risks.
